Just curious…what is the legal age to have sex? 18? If both parties are under the legal age, are they both charged with a crime? What is the penalty for having illegal under-age sex? What about mutual masturbation, would that be an illegal activity for two curious kids to perform, or is that defined as sex? Is there truly a place in the U.S. where two teen-agers might be brought before a judge and asked to plea on charges of engaging in illegal sexual activity while under the legal age?
Answer: There’s no set legal age of consent that covers the entire United States. It’s different everywhere. And there’s different versions of consent, different ages for getting married without parental consent, etc. etc. For instance, one might imagine the age of consent is somewhat lower in Arkansas than in California, though I’m just guessing. 17 seems to be about average in most places as I recall. I’m not sure that in this day and age, a consenting couple, though underage, would find themselves in court over having sex. We can argue that they shouldn’t be having sex yet, but hopefully that argument wouldn’t take place in front of a judge. We’ll leave that to Jerry Springer.
